Time to expel Shaw: Vic Labor (AAP)

It's time to expel independent MP Geoff Shaw from the Victorian parliament, says state opposition leader Daniel Andrews.

He has confirmed Labor will move on Tuesday to have Mr Shaw expelled for misusing his parliamentary car for his private hardware business.

If successful, it would trigger a by-election in Shaw's marginal seat of Frankston months out from the November 29 state poll.

"We have very clear advice from constitutional experts that the parliament can punish Mr Shaw in this way," Mr Andrews told the Nine Network early on Tuesday.

"His conduct, his rorting has been unprecedented and therefore we should act on him today."

Mr Andrews also accused the Napthine government of running a "protection racket" for Mr Shaw because it relies on Mr Shaw's vote to remain in power.

"There is no reason to delay this. There is no reason to continue the protection. One wonders what the rest of Australia thinks is going on down here," Mr Andrews said.

"It needs to end and it needs to end today."

If Mr Shaw is booted permanently from parliament, he would be the first MP in 113 years to be expelled.

Victoria's former speaker, Liberal Ken Smith, has signalled his willingness to vote with the opposition to expel Shaw.
