The Queensland father who nearly took down the school chaplaincy program is headed back to the High Court for round two against the federal government.
Ron Williams won his challenge against government funding of school chaplains in a landmark High Court decision in 2012.
The court ruled the way the program had been funded since it was set up by the Howard government in 2007 was invalid.
Eight days later the federal government enacted new laws to protect hundreds of programs that could have been affected by the decision.
Last August, Mr Williams launched a challenge to that law.
Attorney-General George Brandis raised concerns about the law when he was shadow minister, saying it hardly seemed an adequate response.
One of the defendants on Tuesday is Scripture Union Queensland, which provides most school chaplains in Queensland including at the Williams children's Darling Heights State Primary School.
The national commission of audit recommended the government abolish the scheme, however the coalition promised before the election to keep funding it.
The High Court hearing is expected to run until Thursday.
